Persistent breaches of the partnership agreement? – don’t slice the salami
The recent Court of Appeal decision in Bishop v Golstein has provided welcome clarification on the way to bring a traditional partnership to an end, when one party has breached the partnership agreement repeatedly.
Practitioners are likely, however, to be more interested in the obiter comments of Lord Justice Briggs, regarding the place of repudiation, affirmation and “the last straw doctrine” in partnership law.
