Update on Clark v In Focus appeal

The landmark appeal in Clark v In Focus is today being heard by the Court of Appeal, who will decide whether a complainant can accept an award at FOS and then sue for the balance through the courts.

This case has generated much interest, with FOS making written submissions to the Court of Appeal as an interested non-party.  Regular subscribers to our Regulatory blog will remember that we have been following the progress of this case from the beginning (please see previous Regulatory blogs from 20 December 2012, 10 January 2013 and 18 April 2013).  Judgment is due to be handed down before Christmas, and I will report further then.
