Kate has extensive experience in acting for various leading international insurance brokers where allegations of professional negligence have been made against the broker, with a particular focus on cases involving multi-million pound property damage and business interruption losses. 

Kate also represents for brokers in commercial disputes and has significant experience in acting for brokers who are respondents to third party disclosure applications. 

Kate has also advised on a range of high value, market leading instructions across a range of complex insurance product lines including professional indemnity, D&O liability, aviation, property damage and business interruption cover.

Relevant work

  • Acting for JLT in the reported case of Ground Gilbey Ltd. v Jardine Lloyd Thompson UK Ltd [2011] EWHC 124 (Comm). This case involved allegations or professional negligence against the broker in relation to a multi-million pound property damage and business interruption claim. 
  • Advising various brokers in respect of their ability to provide brokering services and claims handling to aircraft lessors and lessees, in view of sanctions imposed on financial services following the invasion of Ukraine. This advice includes responding to third party disclosure applications by parties to the coverage claims which have been recently issued in the Commercial Court by aircraft lessors, seeking cover under their All Risks and War policies. 
  • Defending a top 4 broker against a broker’s negligence claim regarding the placement of a marine policy for a high net worth individual. 
  • Acting on behalf of a corporate insured on a £125million breach of warranty claim arising out of the purchase of a power station in respect of a property damage and business interruption claim against its insurers. This case was listed in the Lawyer’s top 20 cases of 2012 (GDF Suez International Holdings BV & Ors v Teeside Power Holdings & Ors).
  • Advising Rolls-Royce in relation to its £100million plus claim against its insurers (primary and excess) regarding a marine propulsion system. The case concerned Rolls-Royce’s coverage levels and considered notification issues including scope and timing, and the application of the excess layer policies.  This case was listed in the Lawyer’s top 20 cases of 2013 (Royal & Sun Alliance Plc & Ors v Rolls-Royce).
