New Development: EU Data Act published in Official Journal

The EU Data Act (the Act) came into force on 11 January 2024. The Act sets out rules regarding the fair access to and use of data, aiming to enhance the data economy for individuals and businesses by overcoming barriers to data sharing and establishing frameworks around data access and use.

The Act introduces additional obligations on manufacturers and service providers of internet-connected goods, such as so-called “smart” devices, in relation to consumers’ data. For example, these data holders are required to make data available to users and certain third parties. This aims to establish frameworks for data sharing and allows individuals and businesses to transfer data more easily between service providers.

The Act is a significant piece of the EU’s data strategy, with the majority of the Act’s provisions applying from 12 September 2025.
