Consultation on draft compliance advice for businesses on the marketing of green heating and insulation products |
The purpose of the compliance advice is to help relevant businesses to understand and comply with their existing obligations under consumer protection law when marketing green heating and insulation products for use in the home. The CMA has produced this draft compliance advice following concerns we identified about some businesses in the sector making potentially misleading claims about green heating and insulation products and/or providing limited and inconsistent upfront price information, as part of our review of consumer protection in the sector. The CMA invites interested parties to respond in writing to the questions set out in Section 3 of the consultation document no later than 5pm on 24 January 2024. Hiring agency staff to cover industrial action |
DBT are seeking views on removing regulation 7 of the Conduct Regulations. The government believes it is only right to regulate and restrict business freedom to operate when doing so is both necessary and proportionate. Regulation 7 is a significant interference in the operations of private companies and other employers. It also prevents work seekers being offered certain assignments that they may otherwise wish to take. The government continues to believe in the importance of an individual’s ability to strike and the ability of trade unions to advocate for their members’ interests. However, this needs to be balanced with the rights of third parties not involved in the dispute. Our provisional view is that repealing regulation 7 would help to redress this balance. We welcome views on this from all interested parties, through this consultation. |

Acas consultation on the draft Code of Practice on handling requests for flexible working |
The Department for Business and Trade (DBT) is currently legislating to reform the flexible working provisions set out in the Employment Rights Act 1996. In response to these changes, Acas is updating its statutory Code of Practice on handling in a reasonable manner requests to work flexibly. The updated draft Acas Code is intended to provide employers, employees and representatives with good practice advice on how the new flexible working rules should work in practice. Statutory Codes of Practice are not legally binding, but they are taken into account by courts and employment tribunals when considering relevant cases. |

Consultation on Reforms to PRN and PERN System and Operator Approval DEFRA |
The Government Response to the 2021 consultation on Extended Producer Responsibility (EPR) outlined our decision to retain the PRN/PERN system as an interim solution for managing payments for non-household packaging waste. This system was originally introduced as a way for producers to demonstrate that they have met their statutory recycling obligations each year. The consultation is focusing on the following areas for reform: • Reporting requirements on the sales of PRNs and PERNs; • Reporting requirements on how the revenue from PRN and PERN sales should be spent; • Timeframes for the trading of PRNs and PERNs; • The introduction of a "technical competence" test for compliance scheme operators and accredited reprocessors or exporters; and • The interface with the introduction of the Deposit Return System (DRS). Defra further outlined that it is also seeking views on the introduction of a compliance fee for producers that fail to meet their obligations. |

Implementing due diligence on forest risk commodities DEFRA |
The Government has launched its consultation on how to implement the Due Diligence obligation included in the Environment Act. This will make it illegal for larger businesses in the UK to use commodities whose production is associated with large-scale forest loss such as cocoa, beef, soy, coffee, maize and palm oil, where they have not been produced in line with relevant local laws. Businesses will be also required to undertake due diligence to show that they have taken action to ensure this is the case, and report on this annually. More here. |

Misleading environmental claims CMA |
Investigation into how products and services claiming to be 'eco-friendly' are being marketed, and whether consumers could be being misled. In January 2022 the CMA will begin a review of compliance with consumer law. Should they find evidence of non-compliance they will consider whether further action such as enforcement is necessary and may also take action earlier where there is evidence that consumer law is being broken. |

Packaging and packaging waste: introducing Extended Producer Responsibility DEFRA |
