Richard Breavington

Richard advises insurance companies and their insureds on legal strategy and disputes. His insurance claims expertise includes property and professional indemnity claims, with a focus on technology-related matters, in particular defending technology companies and data breach response.

Richard's career has involved a broad range of litigation experience.  On the claims side, he has advised on a number of significant property and professional indemnity matters.  This has included, in particular, technology claims, including those with strategic and/or regulatory aspects.

Richard is the Partner co-leading the team providing RPC's cyber breach response service, ReSecure.  This is a multi-award winning service which, over the last three years, has worked on numerous and varied data breach incidents.

ReSecure was awarded Best Client Service Innovation at The Lawyer Awards 2017 and helped RPC to be named Adviser of the Year 2017 at the Insurance Day London Market Awards 2017.

Richard also has experience of working with in-house legal teams at insurance companies on a variety of projects, including structuring insurance products and wordings, as well as significant litigation. An example of Richard's strategic disputes experience is advising on recovery of motor repair costs in light of the Court of Appeal case of Coles v Hetherton.

Richard's expertise also covers contentious and non-contentious reinsurance matters, from reinsurance recoveries to setting up reinsurance structures and arrangements.

Advising a price comparison website following a coding error which led to incorrect customer information being passed to insurers. 

Defending a software development company on a claim against it following a high-profile incident in which its software product was unable to meet the customer's requirements.

Advising an insurer on the structuring of insurance products providing cover for peer-to-peer service providers.

Advising a major UK insurer on the presentation of its reinsurance recovery claims in respect of mesothelioma.

Coles v Hetherton – advising Royal & Sun Alliance in the market-leading Court of Appeal case on principles for recovering subrogated motor repair costs.
